The former President of Duval Teachers United (DTU), whom, for purposes of this article, we will refer to as T.B, and a former Vice President, whom we will refer to as R.G.,  were sentenced to federal prison for embezzling over $2.6 million in union funds. T.B. received 27 months, and R.G. was sentenced to one year and one day in prison, followed by six months of home confinement. Both were ordered to pay restitution and forfeit the proceeds of their crimes.

From 2013 to 2022, the two exploited their leadership positions by selling back unearned leave time to DTU, issuing unauthorized bonuses, and submitting fake reimbursements. They concealed their scheme by falsifying records, signing each other’s checks, and misleading auditors and state regulators. This long-running fraud harmed thousands of union members.

The sentencing of T.B and R.G. passes a strong message: abusing positions of trust for personal gain carries serious consequences. This case shows the federal government’s commitment to investigating and prosecuting embezzlement cases to protect the integrity of institutions and ensure justice for victims.

Understanding Wire Fraud and Mail Fraud

Two key charges in this case were wire fraud and mail fraud.

  • Wire Fraud: This charge applies when electronic communications, such as emails, phone calls, or internet transactions, are used to carry out a scheme to defraud. In this case, T.B and R.G used electronic methods to authorize and distribute unearned payments and submit fake reimbursements. These electronic actions were integral to executing and hiding their embezzlement.
  • Mail Fraud: This occurs when the U.S. Postal Service is used to further a fraudulent scheme. The two defendants mailed falsified financial statements and annual filings to the State of Florida’s Public Employee Relations Commission (PERC). Using the mail system to transmit deceptive documents made the scheme a violation of federal mail fraud statutes.
