What Happens if You Are Caught With 20,000 Images of Child Sexual Abuse Material?

Among the most serious charges you can face in Florida, either on the state or federal level, are charges relating to child exploitation. In Florida, if you are found in possession of child sexual abuse material (CSAM), you could face harsh penalties. Cases involving large quantities of CSAM can lead to extremely lengthy prison sentences. In one case, a man was found in possession of 20,000 images of CSAM, some of which he had created himself, and was sentenced to decades in federal prison. A conviction can also result in permanent registration as a sex offender.

About the Case

In this case, a U.S. District judge sentenced a man, whom for purposes of this article, we will refer to as C.L.T., from Palmetto, to 60 years in federal prison for the possession and production of child sexual abuse material. C.L.T. was also ordered to forfeit two phones, an external hard drive, and other proceeds of the offense.

Initially, the defendant was being investigated following allegations of sexual battery of a minor child. After the execution of a search warrant, investigators found almost 20,000 images of child sexual abuse material. Evidence revealed that C.L.T. had created some of the material himself with multiple victims, all minors.

C.L.T. was sentenced in June 2024 after he entered a guilty plea in March the same year.

Federal Laws Governing Possession and Production of CSAM

CSAM possession is governed under 18 U.S.C. section 2252, whereas CSAM production is governed under 18 U.S.C. section 2251. Possession of child sexual abuse material carries a prison sentence of up to 20 years in federal prison. In contrast, production of CSAM carries a prison sentence of up to 30 years. Aggravating factors such as large quantities of CSAM or a criminal history can drastically increase the recommended prison term.

Defending Against CSAM Charges in Federal Court

When faced with charges of possession and/or production of CSAM, it might seem like the end of the road. However, all defendants in the United States, including those facing CSAM charges, are presumed innocent until proven guilty. Not the other way round. The prosecution must prove all the elements of the crime beyond a reasonable doubt. A skilled criminal defense attorney can assess the details of your case and build the best defense strategy.

If appropriate, a plea deal can lead to reduced charges, a lower sentencing range, or a dismissal of certain counts. This option may help avoid the unpredictability of trial and limit your exposure to the maximum penalties allowed under the law.
